Katselis. Specifically, either from the beginning they calculate the interest installment with a high interest rate, resulting in it increasing dramatically, or in the course of the arrangement they ask the borrowers\/debtors for an increasingly larger installment due to the fluctuating interest rates.<\/p>\n<p style=\"text-align: justify;\">Many times this happens because they calculate the interest on the total principal and not on the monthly installment, as it should be. If you are facing this problem, which most people who have a primary residence protected by the N. Katselis decision have unfortunately been facing lately, you should ask for your decision to be interpreted by calculating the interest on the installment and not on the principal.<\/p>\n<p style=\"text-align: justify;\">The recent decisions of the Courts of the Peace of the Country are of particular jurisprudential interest, as they deal extensively with the issue of the method of calculating the interest rate of the regulation of article 9, paragraph 2 of Law 3869\/2010 for the protection of the borrower&#039;s main residence, enriching the case law that imposes interest on the monthly installment and not on the total capital of the regulation of article 9, paragraph 2 of Law 3869\/2010 for the protection of the borrower&#039;s main residence, stating that the payment of the above installments will be made with interest, without compound interest, at the average interest rate of a mortgage loan with a floating interest rate, which will be in effect at the time of repayment according to the statistical bulletin of the Bank of Greece, adjusted with the reference interest rate of the Main Acts. Refinancing of the European Central Bank,<strong> of the interest calculated on the amount of the above-defined installment. <\/strong><\/p>\n<p style=\"text-align: justify;\">For the legal documentation of this choice, the relevant Court decisions state verbatim:<em>\u201c\u2026It is noted that in the cases of Law 3869\/2010, the calculation of interest is made on the amount of the installment defined for article 9, paragraph 2 of Law 3869\/2010, which the Legislator himself confirmed by amending the provision of paragraph 2 of article 9, paragraph 2 of Law 3869\/2010 with Law 4549\/2018, also legally enshrining the uniform method of application of article 9, paragraph 2 of Law 3869\/2010. Indeed, the purpose of Law 3869\/2010 is the settlement of debts, with the aim of saving the principal residence of the requesting debtor.
