TEMPORARY ORDER
The request for a temporary injunction was discussed today on the application for voluntary jurisdiction (Law 3869/2010) of E. P., dated 5-12-2013 and with filing number __/2013, by the applicant with the attorney-in-fact of Agios Zerveas, the first defendant, who was also represented as the universal successor of the third defendant, through the attorney-in-fact of S. L., the second defendant through the attorney-in-fact of E. F., and in the absence of the fourth defendant, although he was summoned legally and within the time limit. The Court, having taken into account the law and the claims of the parties, grants a temporary order suspending the punitive measures against the applicant, and in particular prohibits the initiation or continuation of enforcement proceedings against his property, as well as prohibits any actual and legal change in his financial situation, on the condition that he pays on a monthly basis and within the first five (5) working days of each month the amount of fifty (50) euros to the first defendant, the creditor bank under the name ''EUROBANK ERGASIAS SA'', proportionately distributed between its claims under the mortgage loan contracts Nos. 650000527900 and 650000530271, which are secured in rem on the described in the present application of the applicant's main residence, for which exemption from the sale pursuant to article 9, paragraph 2 of Law 3869/2010 is requested, starting from 1-7-2014, and until 31-3-2015, at which time the request for a temporary injunction will be examined again with the applicant's diligence.
