H ATHENS PEACE COURT
After determining that the attempt at pre-trial settlement failed as the conditions for consent were not met in accordance with the provisions of article 7, paragraphs 2-4 of Law 3869/2010.
Having taken into account article 781 of the Civil Procedure Code
The request for a temporary injunction is GRANTED.
DECIDES temporarily, until the issuance of a final decision on the application filed with filing number __/2014, the suspension of the punitive measures and the maintenance of the actual and legal status of the applicant's assets referred to in the application, with the obligation to pay an amount of 50 euros per month, to be paid from 1/3/2015 within the first five days of each month to Eurobank, a credit banking company, to service its claim which is secured in real terms by a first-in-line real security and a request is submitted to exclude the main residence from the sale (art. 5 par. 2 par. 2, paragraph 2 of Law 3869/2010 as amended by article 13 of Law 4161/2013).
