Buying or selling a property is a decision that almost all of us will have to make at some point in our lives. However, in addition to choosing a property that meets the needs of each interested party and its subsequent possible use by them, during the stage of drawing up the relevant contract, the correct observance of the procedure must be ensured. In the case of a sale, the participation of a lawyer can prove to be crucial for the client on both an advisory and practical level, with guidance in collecting the necessary documents to carry out the purchase and sale, representation during the notarial deed and ensuring payment of the property price to the seller.
In the case of purchase, it is initially necessary to go to the competent Mortgage Registry or Land Registry Office in order to check the seller's title deeds, for at least twenty years, and to issue the corresponding certificates at the same time, in order to establish that no claim has been raised against the property, no encumbrances have been registered, there are no sales to third parties and the title deeds are in full legal order. After signing the contracts, it is necessary to go again within one month to avoid further expenses to the competent Mortgage Registry in order to carry out the transfer, as with this, ownership is acquired.
In any case, in order for the interested party to reach the decision to purchase a property that meets their personal needs but at the same time is functional and economically beneficial, in general, to make a good purchase, it would be advisable to examine the existence of any urban planning violations and to take into account the purchase tax and transfer fees as well as the unified property ownership tax (EN.FIA), since after the purchase, they will be responsible for covering it.
